Buying a plot from outside India
Non-Resident Indians and Persons of Indian Origin can buy residential land in India. The process is the same as for a resident buyer, with a few extra steps around payment and paperwork. Here is what usually applies.
What you can buy
Residential and commercial property, including villa plots. Agricultural land, plantations and farmhouses cannot be bought by NRIs. Vivanta Green Meadows is converted residential land, so it qualifies.
How payment works
Payment is made in Indian rupees, through normal banking channels, from an NRE, NRO or FCNR account. Travellers cheques and foreign currency cannot be used.
Documents you will need
- Passport, and OCI or PIO card if applicable
- PAN card, needed for registration and for tax purposes
- Overseas address proof
- Passport-size photographs
- Power of Attorney, if you are not travelling for registration
If you cannot travel
You can appoint someone in India through a Power of Attorney to sign and register on your behalf. It must be executed at the Indian consulate in your country, or notarised there and then stamped in India within the prescribed period. We will tell you exactly what wording the sub-registrar needs before you sign anything.
Tax
Tax is deducted at source when property changes hands, and the rate differs for resident and non-resident sellers. Rules change, so speak to a chartered accountant about your own situation before you commit. We can put you in touch with one locally.
